Shadowing
Shadowing is a technique performed by monitoring the activities of an individual in a confidential and discreet way, in order to observe the individual in his natural behavior. The main purpose of a shadowing is to obtain evidence of an infringement that causes harm, whether by its findings or by photo or video evidence.
Investigation or shadowing work carried out by an under-qualified investigator may result in an inadmissible evidence file in Court.
This type of file can sometimes even be called "unlawful". In such a situation, the subject could make a claim for civil damages that would be characterized by a significant compensation judgment. In some cases, the investigator in charge could be penalized so that he can no longer practice his profession. RS investigations is totally aware of the case-law on shadowing topic.

The applicant cannot carry out surveillance by Shadowing on the basis of simple doubts. The applicant must first have reasonable grounds to monitor the subject. Reasonable grounds must exist before the decision to shadowing is made. Thus, the reasons cannot be justified by the result of the investigation.

The measure must be proportional to the seriousness of the misconduct and the Shadowing can’t be continuous.

The subject has an expectation of privacy and that is why no video can be taken on the subject for example through the window of his residence.
Reports of the progress of the operation may be made as often as necessary.
